These Terms and Conditions (“Terms”, “Terms and Conditions”) govern your use of the Marketing Botics CRM software service (the “Service”) provided by Marketing Botics Ltd (“us”, “we”, “our”).

 

  1. Acceptance of Terms

By accessing and using the Service, you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by these terms, please do not use or access the Service.

 

User Subscriptions and Payments

  1. Upon registration, users will be provided with a $10 monthly credit for use against emails, texts, and additional features. These credits do not roll over to the following month. Once the initial credit is exhausted, the system will automatically rebill users for additional usage at the following rates:

     

    • Phone costs: 0.0308/min for call made, 0.0187/min per received call (additional cost or phone number will apply)

    • Email: £0.0015 per Email

    • Text: £0.0174 per segment (segment is 160 characters, an emoji counts as 3 segments)

    • LC – Premium Triggers & Actions: £0.022 per workflow premium actions

    • LC Email Verification: £0.0055 per email verification

    • Content AI: £0.198 per 1000 Words, and £0.132 per Image

    • Conversation AI: £0.044 per Message

    • WhatsApp: 0.0777/WhatsApp Conversation (additional cost for Whatsapp Service will apply)

     

    Users have the option to top up their accounts with additional credit at any time.

     

    Additional Usage: Customers’ credit cards will be charged for any additional use above the amount provided per month as part of the plan and any prepaid amount they have added. If we are unable to take the money for the additional costs, we reserve the right to take legal action against the business, which includes charging late payment fees in line with UK law.

    In the event a payment is missed, for both our subscription and rebilling costs, we will try to retake the payment up to 3 more times over 14 days before classing the account as falling into arrears. Marketing Botics Ltd reserves the right to delete the account without further notice. All associated data will be lost permanently. We do not accept responsibility for any data lost due to account deletion resulting from missed payments.

     

    2b. Free Trial:

    If a free trial is offered, a £1 transaction will be processed on the day of sign-up and immediately returned to prove credit card use. The full monthly payment will be taken the day after the free trial ends.

 

3b. Plan changes and Cancellation:

You can change your plan and cancel your subscription with us anytime before the next billing date. You must cancel or change your plan within Sales Ember. Emailing us may not cancel your subscription before your next billing date. You will not receive any part payment for the month you cancel in and upon canceling your account will stay active until the next billing date.

 

  1. Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of Marketing Botics Ltd and its licensors.

 

  1. Limitation of Liability

The Service is provided by HighLevel. As such, we take no responsibility for any actions by HighLevel, including but not limited to loss of data, system errors, or downtime. Marketing Botics Ltd, The Sales Ember brand, its subsidiaries, affiliates, and its licensors do not warrant that a) the Service will function uninterrupted, secure or available at any particular time or location; b) any errors or defects will be corrected; c) the Service is free of viruses or other harmful components; or d) the results of using the Service will meet your requirements.

 

  1. Privacy

Your privacy is important to us. We will never share your personal information with third parties. Please refer to our Privacy Policy for more information on how we handle your personal data.

 

  1. Changes to These Terms

We reserve the right to modify these Terms at any time. We will always post the most current version of these Terms on our website. By continuing to use the Service after the changes become effective, you agree to the revised Terms.
